Bankruptcy in North Texas

Nobody wants to file bankruptcy.  Nobody wants to go to the dentist.  Unfortunately, sometimes you don't have a choice.  When you have a financial debt problem you must seek your debt relief options unless you have the capability of paying off your debt within a short period of time.  Life can go by quickly, and if you have kids they are likely going to want to go to college.  That will get here more quickly than you realize.

When is the 4th amendment implicated?

In a recent criminal defense case the interaction between an officer and the Defendant was a mere "encounter" rather than an investigative detention in Hughes v. State because the officer activated the squad car's white overhead lights rather than the red and blue lights.  Also, the position of the car relative to the defendant's vehicle did not entirely prevent the defendant from leaving. 

What Is an Automatic Stay?

The moment you file for bankruptcy, an automatic stay goes into effect. An automatic stay stops your creditors from bringing lawsuits against you (and stops current lawsuits in their tracks), including foreclosure actions. It also stops wage garnishment, repossession and other collection efforts. This means that filing for bankruptcy stops creditor harassment; once the automatic stay is in place, your creditors must stop calling you.

Chapter 7 Trustee in Plano

The Eastern District of Texas's Bankruptcy Court actually sits in Plano, Texas.  There are four appointed trustees in the Sherman Division which sits in Plano for Chapter 7 bankruptcy.  Christopher Moser, Linda Payne Michelle Chow and Mark Weisbart preside over the Chapter 7 First Meetings of Creditors which are referred to as 341 meetings after the corresponding Chapter in the Bankruptcy Code.
